Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Authentica mobile application or website (collectively the "Service"), you agree to be bound by these Terms of Service. If you do not agree do not use the Service. Authentica LLC reserves the right to modify these terms at any time. Continued use of the Service after modifications constitutes acceptance of the updated terms.

2. Description of Service

Authentica provides an AI-powered product authentication analysis service. The Service analyzes photographs of physical items and returns an authentication assessment based on visual pattern recognition and machine learning technology. Authentica is a technology platform and does not provide professional appraisal, legal certification, insurance valuation, or expert witness services. Images submitted for authentication may be used to improve Authentica's AI model. Images are stored securely and are never shared with third parties.

3. Limitation of Liability

AUTHENTICA'S AUTHENTICATION VERDICTS ARE INFORMATIONAL ASSESSMENTS ONLY AND DO NOT CONSTITUTE PROFESSIONAL AUTHENTICATION, LEGAL CERTIFICATION, OR A GUARANTEE OF AUTHENTICITY OR INAUTHENTICITY.

Authentica LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Any authentication verdict that is later determined to be incorrect
• Any financial loss arising from reliance on an Authentica verdict
• Any transaction entered into based on an Authentica verdict
• Any physical damage, loss, or theft of items submitted for authentication
• Any business loss, lost profits, or reputational harm arising from use of the Service

YOUR USE OF AUTHENTICA IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS.

4. No Professional Authentication Guarantee

Authentica's AI model uses pattern recognition technology. No AI system is 100% accurate. Authentica expressly disclaims any warranty that its verdicts are correct, complete, or reliable. For high-value transactions we strongly recommend seeking additional professional authentication from qualified human experts before making a purchase or sale decision.

5. Indemnification

You agree to indemnify, defend, and hold harmless Authentica LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your reliance on any authentication verdict provided by the Service.

6. Arbitration & Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. The arbitrator's decision shall be final and binding.

7. Intellectual Property

Authentica's weighted marker taxonomy, authentication methodology, AI model architecture, and all related trade secrets are the exclusive proprietary property of Authentica LLC. You may not reverse engineer, decompile, copy, or attempt to replicate Authentica's authentication methodology.

8. Subscription Terms

Authentica offers the following paid subscription plans:

• Pro Monthly: $9.99/month (Founding Member rate: $4.99/month)
• Pro Annual: $19.99/year (Founding Member rate: $19.99/year) — includes a 3-day free trial for new subscribers
• Vault: $79.99/month — no free trial

Auto-Renewal: All subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged at confirmation of purchase and at the start of each renewal period.

Free Trial: The Pro Annual plan includes a 3-day free trial for new subscribers only. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to the paid annual plan and your Apple ID will be charged $19.99 (or your applicable Founding Member rate).

Cancellation: You may cancel your subscription at any time through the Authentica app (Profile → Manage Subscription → Cancel Subscription) or through your Apple ID settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to your paid tier until that date.

Founding Member Pricing: Users who subscribe during the Founding Member period lock in their discounted rate permanently. This rate will never increase as long as the subscription remains active and in good standing.

Refunds: Refunds are not provided for unused scans within a billing period. For refund requests contact legal@authenticaapp.com or submit a request through Apple's standard refund process.

9. Account Security & Prohibited Sharing

Sharing account credentials or promo codes is prohibited and will result in immediate account termination without refund. Each account is limited to two active sessions simultaneously. Authentica reserves the right to terminate any account found to be shared across multiple users or devices beyond the allowed session limit.

10. Prohibited Uses

You may not use the Service to facilitate fraud, misrepresent the authenticity of items in commercial transactions, or circumvent intellectual property protections. Bulk automated access without written enterprise API authorization is prohibited.

11. Termination

Authentica reserves the right to terminate or suspend your access to the Service at any time for violation of these Terms, fraudulent activity, or any other reason at Authentica's sole discretion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which Authentica LLC is registered, without regard to conflict of law principles.
